Procedure for Filling in the Passenger Customs Declaration


Chapter 1. General Provisions

    The present procedure for filling in the passenger customs declaration has been elaborated in accordance with Article 355 of the Customs Code of the Customs Union. The passenger customs declaration form (hereinafter the Declaration) consists of the main form and the complementary form called “The declaration of cash and/or monetary instruments (hereinafter the Cash Declaration) which is annexed to the main Declaration form and shall be filled in cases provided by the present Procedure. The Declaration form has the following dimensions: 148 x 210 mm (A5 format) or 210 x 296 mm (A4 format); the form is made typographically or printed by means of computer print-out devices. The Declaration forms can be made using self-replication paper. The customs applicant shall complete the Declaration by hand clearly and legibly or print it by means of computer print-out devices, filling in the required fields of the Declaration with information on the goods moved across the Customs Union border (hereinafter the Customs Border) and with other information required for customs purposes in compliance with the customs legislation of the Customs Union. Submission of the electronic copy of the Declaration is not required. Information shall be presented in the official language of the Customs Union member state, in Russian or in English, and also – with permission of the customs authority – in any other language spoken by the officials of such customs body. Should one Declaration form (hereinafter the Main Sheet) be insufficient for presentation of information about all transported goods, the required quantity of such Declaration forms shall be used (hereinafter the Additional Sheet). Data on the goods subject to indication in Items 3.1, 3.3 and Item 4 of the Declaration, can be presented in Additional Sheets of the Declaration. The items in Additional Sheets shall be completed according to the rules of filling in the appropriate items of the main Declaration form. The completed Additional Sheets shall make an integral part of the Declaration.
    With permission of the customs authority at a well-grounded request of the customs applicant information set out in the Declaration may be amended or supplemented prior to release of goods, in case provided changes or supplements have no influence on making a decision on the goods release and cause no necessity to change any data affecting the calculation of the amount of customs payments and compliance with bans and restrains.

    Amendments and supplements of the data submitted in the registered Declaration cannot involve presentation of data on goods other than those provided in the registered Declaration.

    Any amendments and supplements of the Declaration shall be signed by the customs applicant and sealed with the personal seal by the authorized customs body registered such Declaration.

    The customs applicant shall indicate the required data in the Declaration, in particular, by checking the appropriate boxes (the checked box means an affirmative answer, otherwise the answer is negative).

    One copy of the main Declaration form with the complementary form of the Declaration (if completed) shall be kept in the files of the customs body.

Chapter 2. Procedure for Filling in the Main Form of the Declaration

    The Declaration shall be made in duplicate for the purposes of customs declaring of the following types of goods: goods carried in the customs territory of the Customs Union in accompanied baggage in case the natural person moving these goods has unaccompanied baggage when crossing the Customs border; goods transported across the Customs border in unaccompanied baggage; goods in respect of which the customs applicant expresses his/her willingness to conduct identification; vehicles for personal use, temporarily imported into the customs territory of the Customs Union.In other cases the second copy of the Declaration shall be made at will of the customs applicant. The customs applicant, at his will, can make three or more copies of the Declaration. The central customs body of the Customs Union member state, namely: the State Customs Committee of the Republic of Belarus – from the Belarusian Party, the Customs Control Committee of the Ministry of Finance of the Republic of Kazakhstan – from the Kazakhstan’s Party, the Federal Customs Service – from the Russian Party, may establish cases when for declaring vehicles the Declaration shall be completed in one copy. In the boxes “Entry”, “Departure” the customs applicant shall indicate the direction of goods transportation. In Item 1 of the Declaration the customs applicant shall fill in his/her personal details, data on his/her identity document, information about persons under sixteen (if any) who travel together with the customs applicant – by ticking the appropriate “Yes”, “No” boxes, and indicating their quantity in the “Quantity” field. In Item 2.1 of the Declaration the customs applicant, by ticking the appropriate “Yes”, “No” boxes, shall indicate presence or absence of the goods, transported by him/her in accompanied baggage. Should such goods be available, the total quantity of items of baggage shall be indicated in figures in the “Quantity of items” field in Item 2.1 of the Declaration. In Item 2.2 of the Declaration the customs applicant, by ticking the appropriate “Yes”, “No” boxes, shall indicate presence or absence of the goods, transported by him/her in unaccompanied baggage. Should such goods be available, the quantity of items of baggage shall be indicated in figures in the “Quantity of items” field in Item 2.2 of the Declaration. At the point of arrival at the customs territory of the Customs Union, such information shall be treated as a notification to the customs body of presence or absence of the goods transported by the customs applicant in unaccompanied baggage. In Item 2.3 of the Declaration the customs applicant, by ticking the appropriate “Yes”, “No” boxes, shall indicate presence or absence of his/her goods transported by the carrier. Should such goods be available, the total quantity of items of baggage shall be indicated in figures in the “Quantity of items” field in Item 2.3 of the Declaration. In Item 3.1 of the Declaration the customs applicant, by ticking the appropriate “Yes”, “No” boxes, shall indicate presence or absence of cash of the Customs Union member states, foreign currency, travel cheques to the amount not exceeding USD 10000 in the equivalent. At will of the customs applicant, information on available cash and travel cheques shall be completed in this item. The type of currency or kind of a monetary instrument – “travel cheques” shall be indicated in the “Name” field. The sum shall be indicated in the units of currency (currency of the travel cheques par value). In Item 3.2 of the Declaration the customs applicant shall notify of his/her moving cash currency of the Customs Union member states, foreign currency, travel cheques to the amount exceeding USD 10000 in the equivalent and/or bills of credit, (bank) cheques, by ticking the appropriate “Yes”, “No” boxes. Should the answer be “Yes”, the customs applicant shall fill in a complementary form – the Cash Declaration. Should the mentioned goods be transported, information on such goods shall be entered in the Cash Declaration. In Item 3.3 of the Declaration the customs applicant, by ticking the appropriate “Yes”, “No” boxes, shall notify of his/her moving any transported vehicles for personal use. Additionally, information about such vehicles, separately for each kind thereof, shall be indicated in this item. An Additional Sheet for each vehicle shall be filled in. In Item 3.4 of the Declaration the customs applicant, by ticking the appropriate “Yes”, “No” boxes, shall notify of his/her moving goods with respect to which any bans or restrains have been imposed by the legislation of the Customs Union. Should such goods be available, information about such goods, and also data on the documents confirming the compliance with such restrains and on the issuing authority shall be indicated in Item 4 of the Declaration. In Item 3.5 of the Declaration the customs applicant, by ticking the appropriate “Yes”, “No” boxes, shall notify of his/her moving any indivisible goods of weight exceeding 35 kg and/or goods of the total weight exceeding 25 kg and/or of the total customs value exceeding EUR 500. Should such goods be available, detailed information about them shall be completed in Item 4 of the Declaration. In Item 4 of the Declaration the customs applicant shall indicate the following data on the goods mentioned in Item 3.4, 3.5, the goods subject to customs declaring, and other goods at will of the natural person:

      name and distinguishing features (what material such goods are manufactured of, colour, shape, brand, identification numbers (if any);
      details of the documents confirming the compliance with restrains;
      weight/quantity;
      customs value of goods (in the currency of the Customs Union member state, Euro or US dollars).
    Should the Declaration be made with respect to goods carried in unaccompanied baggage – if such baggage has been taken for transportation by the air carrier as accompanied one, but in the course of transportation, by any reason beyond the control of the natural person, has not been delivered to the destination place at once with the arrival of such natural person – the customs applicant, apart from the data mentioned in the first part of this item, shall indicate the details of documents about the baggage delivery to the air carrier or other documents enabled to identify such baggage. When filling in Additional Sheets of the Declaration, the customs applicant shall make an entry: “sheet No.___ ” on the upper right-hand corner of the sheet face, and data on the customs applicant of the transported goods shall be indicated there (surname, name, patronymic, his/her country of residence and identity document (series and passport number or other identity document) mentioned in Item 1 of the Main Sheet. When filling in Additional Sheets of the Declaration, the customs applicant shall make an entry: “ _______Additional Sheets”; quantity of such Additional Sheets shall be indicated in words. All copies of the Declaration (the Main and Additional Sheets) shall be signed by the customs applicant or the authorized person of the customs representative; date of filling in the Declaration shall be indicated on the Sheets. At submission of the Declaration by the customs representative the following information shall be indicated in the Declaration below his signature:

      registration number of the customs representative according to the register of the customs representatives;
      position, surname, name, patronymic of the customs representative’s worker, engaged in customs operations;
      document number under which the customs representative carries out customs operations on behalf of the customs applicant.

Chapter 3. Procedure for Filling in the Cash Declaration

  1. The cash declaration shall be filled in case of moving:
    1. cash (banknotes and coins, except precious metal coins) and travel cheques to the amount exceeding USD 10 000 in the equivalent;
    2. other monetary instruments in document form (bills of credit, cheques (bank cheques), as well as securities in document form attesting the issuer’s (debtor’s) obligation to pay the cash with no particular payee specified).
    When completing the form, information shall be provided on all cash, travel cheques and monetary instruments moved.
  2. The Cash Declaration shall be completed in two copies and signed by the customs applicant. Additionally, the customs applicant shall date the form.
    One copy of the Cash Declaration together with the Main Form shall be kept in the customs body. The second copy of the Cash Declaration with a relevant mark made by the customs body, shall be kept by the customs applicant.
  3. In Item 1 of the Сash Declaration, the customs applicant shall provide his/her personal information. The address of stay (registration) in the customs territory of the Union and the details of the document certifying the right to stay in the customs territory of the Union (if any) shall be specified by persons not being citizens of the Union member states.
  4. In Item 2.1 of the Сash Declaration, the customs applicant shall indicate the amount for each currency type moved, including the currencies of the Union member states, in terms of the currency units.
  5. In Item 2.2 of the Сash Declaration, the customs applicant shall indicate the nominal value or its equivalent in the currency of the Union member state or the foreign currency, to which the right is certified by the monetary instrument. If the nominal value is not available and it is impossible to determine its equivalent in currency of the Union member state or the foreign currency, to which the right is certified by the monetary instrument, the number of the monetary instruments moved shall be specified.
  6. In Item 3 the customs applicant shall check “another person” in case of moving cash (money) not owned by him/her. In case “another person” is checked in Item 3.1 the customs applicant shall indicate the name and location address (legal address) of the enterprise, company or entity owning the cash and (or) monetary instruments moved.
  7. In Items 4 or 5 of the Сash Declaration, if the customs applicant checks “other”, the source of income or the intended use of the declared cash and (or) monetary instruments shall be indicated.
  8. In Item 6 of the Сash Declaration, the point of departure (the country from which the declared cash and (or) monetary instruments are exported or were exported) shall be specified in Country of Departure, and the country being the customs applicant’s point of destination shall be specified in Country of Arrival. Accordingly, the date of departure shall be the date of leaving the country of departure, and the date of arrival shall be the date of arrival at the point of destination.
  9. In Item 6.1 of the Сash Declaration the type of transport used to arrive at or depart from the customs territory of the Union shall be also indicated.
